1. Introduction and Acceptance of Terms
Welcome to JobCalc, operated by JobCalc. These Terms of Service ("Terms") govern your access to and use of the website located at https://www.jobcalc.co.uk (the "Service"). When we say "JobCalc," "we," "us," or "our," we are referring to the company operating this Service. When we say "you" or "your," we mean the individual or entity accessing or using the Service.

These Terms form a legally binding agreement between you and JobCalc. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you don't agree with any part of these Terms, then you must not use the Service. Your continued use of the Service means you accept any changes we make to these Terms.

2. Account Registration and Security
2.1 Account Creation
To access the features of the Service, you'll need to register for an account. You must provide accurate, complete, and current information during the registration process. You agree to update this information promptly if it changes. We can't be responsible for issues arising from outdated or incorrect account details.

2.2 Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account login credentials, including your password. You're also responsible for all activities that occur under your account. If you suspect any unauthorised use of your account or a breach of security, you must notify JobCalc immediately at jobcalcinfo@gmail.com. We won't be liable for any loss or damage arising from your failure to comply with these security obligations.

2.3 Eligibility
You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.

3. Subscription Plans, Billing, and Payments
3.1 Subscription Plan
JobCalc offers a single subscription plan JobCalc at £14.99 per month. New users receive a 30-day free trial before billing begins. Full details are available at https://www.jobcalc.co.uk. We reserve the right to modify our pricing at any time, but we'll provide you with at least 30 days' notice before any changes affect your current subscription.

3.2 Recurring Billing
When you subscribe, you agree to pay the applicable subscription fee on a recurring monthly basis as specified during sign-up. Payments are automatically charged to your chosen payment method at the beginning of each billing cycle. Payments are processed securely by Stripe, Inc. on our behalf. You authorise JobCalc to charge your payment method for all applicable fees until your subscription is cancelled.

3.3 Price Changes
We may change the fees for our subscription plan. If we do, we'll give you at least 30 days' notice before the new prices take effect. This notice will be sent to the email address associated with your account. If you don't agree with the new prices, you can cancel your subscription before the next billing cycle begins.

3.4 Cancellation
You can cancel your JobCalc subscription at any time through the Stripe Customer Portal, accessible via the "Manage Subscription" button in your account dashboard. Your cancellation will take effect at the end of your current billing period, and you will retain access to the Service until that date. We do not provide refunds for any unused portion of a subscription period, except where required by UK consumer law. If you cancel within 14 days of your initial purchase, you may be entitled to a pro-rata refund for the unused service, in line with UK distance selling regulations.

3.5 Free Trial
New users are eligible for one 30-day free trial per account. No payment is taken during the trial period. At the end of the trial, your subscription will automatically convert to a paid plan at £14.99 per month unless you cancel before the trial ends.

3.6 Failed Payments
If a payment fails, we'll notify you and may retry the payment. If payment isn't successfully made after a reasonable number of attempts, we reserve the right to suspend or terminate your access to the paid features of the Service until payment is received.

4. Your Content and Data
JobCalc allows you to create and store job calculations, estimates, and related data ("Your Content"). You retain full ownership of all content you create using the Service. JobCalc does not claim any ownership rights over your calculations, quotes, or project data.

We will not use Your Content for any purpose other than providing and improving the Service to you. Upon account termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

5. Intellectual Property Rights
5.1 Our Property
The Service and its original content, features, and functionality are and will remain the exclusive property of JobCalc and its licensors. This includes all software, text, images, graphics, logos, and other materials. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JobCalc.

5.2 Your Limited Licence
Subject to your compliance with these Terms, JobCalc grants you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal or internal business purposes. This licence does not permit you to reproduce, distribute, modify, or create derivative works of any part of the Service.

6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the Service. You must not:

    Use the Service in any way that violates any applicable local, national, or international law or regulation.
    Impersonate or attempt to impersonate JobCalc, a JobCalc employee, another user, or any other person or entity.
    Introduce any viruses, Trojan horses, worms, logic bombs, or other malicious or technologically harmful material.
    Attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of the Service or any server or database connected to the Service.
    Use any automated device, process, or means to access the Service for any purpose, including scraping or copying any material on the Service.

If you violate this policy, we may suspend or terminate your access to the Service immediately.

7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms - for example, if you fail to pay your subscription fees or misuse the Service.

If you wish to close your account, you can cancel your subscription via the Stripe Customer Portal and contact us at jobcalcinfo@gmail.com to request account deletion. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall do so, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimers
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. JobCalc expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The calculations and estimates provided by JobCalc are for general informational and estimation purposes only. Material quantities, costs, and labour requirements may vary depending on site conditions and other factors. You should always verify measurements on-site before ordering materials. We don't guarantee the accuracy or completeness of any calculations or data generated by the Service.

9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall JobCalc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

    Your access to or use of or inability to access or use the Service.
    Any conduct or content of any third party on the Service.
    Any content obtained from the Service.
    Unauthorised access, use, or alteration of your transmissions or content.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law in the United Kingdom.

10. Indemnification
You agree to defend, indemnify, and hold harmless JobCalc and its licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) resulting from or arising out of your use of the Service or a breach of these Terms.

11. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, typically by email or by posting a notice on the JobCalc website. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.

13. Miscellaneous Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy and Disclaimer published by JobCalc on the Service, constitute the entire agreement between you and JobCalc concerning the Service.

13.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full effect.

13.3 Waiver
Any failure by JobCalc to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.
